Ownership of a sperm sample
I have an stimulating question for all the embryo mail folks. In the past few days we received a weird request in our IVF program. A young woman called requesting us to freeze her boyfriend sperm. She alleged that the only available sample was inside of her because she had intercourse with him two days ago, and he passed away after that. This bizarre request raises many doubts among the members of our group regarding the ownership of the sperm sample. The sample, of course, belongs to the man that produces it, but once inside of her, can she dispose of this sample at her will? Can she sign a consent form to freeze that sample to be used in any procedure in the future?

Hi Grace:
The only proof of his dead was her black color dress, her sadness and tears. Regarding the sperm, not even a sperm was seen, but is the legal issue what raises the controversy in our program. We thought about the possibility to face a similar request in the future but with someone who had a sex encounter just hours ago, if it was a consent intercourse, if the sample is now in her body, can she legally claim ownership on this sample? Can she dispose of this sample at her will because he consent the relation and she can decide about her body? I’m not a member of the American Society of Andrology, so if you still want to comment this case there, please, go ahead and let me know what they say about.
